Delta 9 Brands is a Canadian company that manufactures and distributes legal medical marijuana.
Their products are grown in small quantities in northwestern Ontario and have been given the highest quality assurance award by the Canadian government’s department of agriculture and agri-food and you can visit their official site here.
Products include cannabis, cannabis oil, and other pot products like pre-rolled joints, THC-infused drinks, gummies, and capsules. They produce dried flower in both Sativa (psychoactive) and Indica (sedative). Delta 9 also has a variety of edibles available from cookies to brownies to “every type of edible product you could think of.” Delta 9 also has a line of THC-enhanced protein powder marketed for human consumption and a pot delivery service.
Delta 9 was also the first legal licensed producer to offer extracts in Canada, with their “Delta 9 Sweet Skunk” extracts in 2014.
The company is currently involved in a lawsuit with Health Canada over the possession of medical marijuana while travelling across the country.
One of their licensees was fined $300,000 at the Canadian Federal Court on February 25, 2018.
In 2013, Delta 9 received its federal licence to cultivate marijuana under Health Canada’s Marihuana Medical Access Regulations (MMAR).
The MMAR allows users to register with the Government to have access to medical marijuana from licensed producers. Delta 9’s facilities are located in London, Ontario, a region of Canada that has been called home by many marijuana users for years. In November 2015, Delta 9 opened a new production facility in Leamington, Ontario in close proximity to the Windsor-Detroit border.
On May 22, 2015 Health Canada suspended Delta 9’s licence for violations of MMAR rules.
On July 28, 2015 Health Canada announced that their investigation into Delta 9 would terminate their license based on “insufficient information”.
Delta 9 CEO John Arbuthnot said that his company was unable to renew their license because it “had been in a state of limbo for the past few months” due to a court challenge from another licensed producer. The government claims that Delta 9 had grown more marijuana than allowed by their licence and failed to keep proper records. In a statement, Health Canada said: “The termination of the licences does not have any impact on the amount of dried marijuana that individuals who have valid authorizations may possess or where they may store it.”

According to Health Canada, the federal government does not recognize any exceptions for medical marijuana users carrying their marijuana across provincial boundaries. Delta 9’s lawsuit argues that this is a violation of their constitutional rights.
The company also challenges rules requiring medical pots users to purchase new plants each time they run out, arguing that it is “abhorrent” and costly compared with giving people the option of growing their own plants.
